This page presents general Terms & Conditions for both bloggers and Advertisers.

Terms and conditions

OPPORTUNITIES.

Participating Advertisers create and list opportunities ("Opportunities") in the Marketplace located on the PayingPost site, which offer Bloggers the chance to receive compensation from the Advertiser in exchange for creating blog posts on their blogs which comply with the requirements set forth in the Opportunity. Each Opportunity listing contains a description of the desired blog post (herein referred to as the "Requirements") and the compensation to be paid by the Advertiser. The Advertisers are solely responsible for the content of their Opportunities listings and for the payment of any identified compensation to the Bloggers.

REVIEWS & APPROVALS.

While PayingPost may assist in reviewing and identifying Blogger's posts that violate an Opportunity's Requirements and attempt to resolve disputes, Advertisers in their sole discretion shall determine whether a particular blog is entitled to the set compensation so long as the Advertiser observes the requirements are acomplished. Blog posts which do not comply with the requirements of the Opportunity will not be entitled to the compensation associated with such Opportunity.

PayingPost DIRECT.

PayingPost Direct is a self-serve portion of the Marketplace for Advertisers and Bloggers. PayingPost does not review any PayingPost Direct posts or Opportunities. Once an PayingPost Direct Opportunity has been agreed upon and submitted by a Blogger, an Advertiser has four (4) days to respond with any requested modifications.

ADVERTISER SPECIFIC TERMS.

This Section applies only to Advertisers participating in the Marketplace.

TRANSPARENCY & DISCLOSURE.

PayingPost requires full disclosure by all Marketplace participants. Any attempt to instruct, coerce or manipulate a Blogger into hiding the commercial relationship between you and the Blogger may result in removal from the system. Advertiser agrees to comply the Federal Trade Commission's Staff Opinion Letter dated December 7, 2006, WOMMA's Ethical Blogger Contract Guidelines, and all applicable laws and regulations, including but not limited to Section 5 of the Federal Trade Commission Act and the Federal Trade Commission's Endorsement Guidelines.

POST DISPUTES.

Advertiser agree that so long as a Blogger has met the requirements as outlined in your Opportunity you will not deny payment. Advertiser may not discriminate based on aesthetics, grammar, blog layout, or the racial, physical, political, spiritual, age, gender or sexual orientation characteristics of the Blogger. Payment will be made to the Blogger unless the Blogger has violated the terms of this Agreement or the specific terms of your Opportunity as stated in writing.

BLOGGER SPECIFIC TERMS.

This Section applies only to Bloggers participating in the Marketplace.

TRANSPARENCY & DISCLOSURE.

Bloggers participating in the PayingPost Marketplace must clearly disclose on their blogs the relationship between themselves and the Advertisers in connection with Opportunity-related posts. The appropriate manner in which to make such disclosure (e.g., site wide disclosure policy or disclosure on a per post basis) may vary with the circumstances and is to be determined by the Blogger. PayingPost requires, however, that disclosure be made in a meaningful way that makes clear to an ordinary consumer that there is a relationship between the Blogger and the Advertiser.

FULFILLMENT OF COMPENSATION.

Blogger acknowledges and agrees that the obligation to compensate Blogger for Opportunity-related posts resides with the Advertiser, not PayingPost. PayingPost merely facilitates such compensation on behalf of the Advertisers. Blogger waives any and all claims or rights of action against PayingPost relating to the failure of an Advertiser to compensate Blogger in connection with an Opportunity-related post. In addition, Blogger acknowledges that Blogger is: (i) not an employee of PayingPost, (ii) responsible for the payment of all federal, state and local taxes on compensation received from an Advertiser, (iii) responsible for any reporting requirements imposed by the federal, state or local government, and (iv) responsible for compliance with all other applicable laws and regulations.

BLOG ELIGIBILITY.

In order to participate in the PayingPost Marketplace, Blogger must register your blog(s) with PayingPost and meet the minimum eligibility requirements. PayingPost will not accept certain blogs and Bloggers as determined by PayingPost in its sole discretion.

  • Blogs Only. PayingPost only accepts blog.
  • English Only Blogs. The blog and all posts relating to PayingPost Opportunities must be in the English language or such other language as is identified in the particular Opportunity.
  • Original Blog Content. The blog must contain original editorial content in addition to Opportunity-related or other paid posts. Blogs that exist primarily for payment will not be accepted.
  • Minimum Blog Age. Blogs must be live for a minimum of ninety (90) days, counted from the date of the blog's first post, with at least twenty (20) pre-existing posts written in the 90 days prior to registration with the PayingPost Marketplace.
  • Chronological Archives. Blogs must have a chronological archive to verify age. Categorical archives will not be accepted. You acknowledge and agree that PayingPost may also verify compliance with these age and posting requirements via a third party spider.
  • Transfer of Blog. Transferring your blog to a new domain does not make the blog older than ninety (90) days. Transferring a blog to a new owner does not make the blog 'older than ninety (90) days.'
  • Inappropriate Content. Blogs submitted to the marketplace may not include or support: excessive profanity, violence, or racial intolerance, illicit drugs or drug paraphernalia, pornography, adult or mature content, or any other content that promotes intolerance, illegal activity, or infringes on the legal rights of others.

BLOG EXCLUSIONS.

The following blog types are wholly excluded from Marketplace Opportunities:

  • No Follow Blogs. Blogs must not include nofollow tags in the robots meta tags, though Advertisers may request nofollows with their required links.
  • Photoblogs and Vlogs. Blogs whose posts are primarily composed of non-written entries (such as Photoblogs, comics, or vlogs).
  • Third Party Content Blogs. Blogs whose entries are made up entirely of song lyrics, quotes, poems, online quizzes/surveys, information directories, or other such lists that do not constitute written entries.
  • Community Blogs. Blogs with more than one contributor/author.
  • Blog For Money Blogs. "Blog for money" community blogs such as BlogCharm, BloggerParty and WritingUp.com.

POSTING REGULATIONS.

If Blogger has a blog accepted into the Marketplace, Blogger must comply with the following Posting Requirements:

  • Frequency of Posts. You may post a maximum of three (4) PayingPost Marketplace Opportunity-related posts per blog in any given day. PayingPost posts may not appear consecutively on your blog. Each PayingPost post must be immediately preceded and immediately followed by at least one non-sponsored, original content post.
  • Non-Sponsored Posts. Your last non Opportunity-related post must have been within the seven (10) days immediately preceding your Opportunity-related post. After any break in blog activity of seven plus (10+) days, interim posts, that is, posts between Opportunity-related posts, submitted on the same day as your paid Opportunity-related posts will not count towards this requirement.
  • Private Posts. Interim posts must not be labeled "Private" or locked out. Interim posts must also be of a reasonable length, at least one (1) paragraph, three (3) to five (5) sentences. If your blog's interim posts lack quality PayingPost may terminate your account.
  • Obstructions. Elements on a blog page must not obscure any portion of an Opportunity-related post and the posting must be visible, readable and reasonably coherent.
  • Inline Ads and Links. You can use max 2 highly relevant links in a given sponsored post pointing to authoritive websites like Wikipedia. these links will be used only for informational purposes.
  • Unique Content. Identical or nearly identical Opportunity-related posts will not qualify for payment under the Marketplace and may result in termination of your account.
  • Time Shifting. A submitted Opportunity-related post's date of submission to PayingPost must match the date of creation as reflected in your blog time stamp, date line or archives. A submitted post's date must also be relative to the timeframe of an Opportunity's life span.
  • Inappropriate Content. Posts submitted to Marketplace Opportunities may not include or support: excessive profanity, violence or racial intolerance, illicit drugs or drug paraphernalia, pornography, adult or mature content, any other content that promotes intolerance, illegal activity, or infringes on the legal rights of others.
  • Nofollows. Nofollows may only be included within the required link of a post, or additional required links, if the Advertiser chooses the nofollow option during Opportunity creation. Unless an Advertiser chooses this option, required links are not to have nofollow attributes within them. Here is an example of a nofollow attributed link: <a rel="nofollow" href="http://www.example.com/">Anchor Text</a>

PAYMENTS

  • All payments are made via PayPal. Advertisers can fund their account and PayingPost will pay Bloggers using PayPal. When your total unpaid earnings reach $100, we'll send you a payment on the 1rst of the next month. For example, if your total unpaid earnings reached $100 during November we would send you a payment on December 1. If your total unpaid earnings haven't yet reached $100, they'll roll over to the next month and accrue until they meet the $100 threshold. We do realise that for some of you this is an inconvenient but we're forced to apply this term in order to reduce the monthly refunds to advertisers. The reason we have to do refunds are: bloggers use to nofollow links, delete links, delete posts, delete entire blog, obviously after payment is received. Once you decide to reserve an opportunity you agree with thes Terms and Conditions.
